Aspects not covered in the Free Course:

It is important to note that in all the contracts the appointment of the representatives must be by the employer, and it must be in writing. Also, the delegation of functions by the representatives must be in writing and it must be specific.

Penalties / Delay Damages can be deducted even if there are EOT claims in the process to be evaluated.
If the maximum amount of Penalties / Delay Damages is not capped, it may/will be detrimental to the contractor. the work, or the time needed to complete a project.

Claims & Time-barring clauses are common in all the conditions of contracts. Although a contractor may deem a time-barring clause unfair, the courts apply it rigidly. Once a contractor (or employer) defaults in relation to a time-barring clause, there is no way in which it can be reversed.

All conditions of contracts include either direct Force Majeure clauses or clauses that relates to similar events which entitles the contractor to claim for extension of time and in some instances also monetary reimbursement.

In FIDIC the dispute procedure is detailed in Sub-Clauses 20.2 [Appointment of the Dispute Adjudication Board], Sub-Clause 20.3 [Failure to Agree Dispute Adjudication Board], Sub-Clause 20.4 [Obtaining Dispute Adjudication Board’s Decision], Sub-Clause 20.5 [Amicable Settlement], Sub-Clause 20.6 [Arbitration] and Sub-Clause 20.7 [Failure to Comply with Dispute Adjudication Board’s Decision].
